INTRODUCTION AND ACCEPTANCE OF THE TERMS AND CONDITIONS
The general Terms and Conditions of Sale detailed below govern the contractual relationship between the ‘User’ (hereafter also referred to as ‘You’ or the ‘Customer’) and ‘WaterForce Limited’ (hereafter also referred to as ‘We’ or the ‘Web Store’), belonging to the New Zealand registered company WaterForce Limited. Both parties accept these Conditions unreservedly. These general Conditions of Sale are the only conditions that are applicable and replace all other conditions, except in the case of express. written, prior dispensation. We maintain that, by confirming your order, you have read and do unreservedly accept our general Conditions of Sale. These Terms and Conditions of Sale are important to you and WaterForce Limited as they are used to protect your rights as a valued customer and our rights as a business.

CHANGES TO THE TERMS OF SERVICE AND THE WEB STORE
We reserve the right to update the web store and these terms of service from time to time at our discretion. At the time of engagement or purchasing online, it is emphasised that at the time of such engagement with WaterForce Limited it will be on the basis of the current updated terms and conditions and it is your responsibility to ascertain the current and updated terms and conditions at the time of any purchase. Your continued use of the web store following the publishing of updated terms and conditions will be taken to mean that you have read and agreed to the changes.

PRODUCT INFORMATION
WaterForce takes great care when putting product information, descriptions, images and videos online but while it will take appropriate steps to correct any mistakes or omissions, it is acknowledged and agreed by the customer that WaterForce will not have any liability to damages arising from such mistake or omission in any manner whatsoever.

PRICES
The prices indicated on our site are shown in New Zealand dollars (NZD). The price of the products are clearly shown and invoiced at the end of the order. We reserve the right to modify our prices at any moment, but this will be indicated to you on the order at the time the order is placed. If an obviously incorrect price appears on our Web Store and is not corrected on your total at the time of order completion, for whatever reason (human error, technical error etc.), your order will be cancelled and the payment refunded to you, even if it has been initially validated.

AVAILABILITY
Products on this Web Store will only be shipped to a delivery address within New Zealand.

We will always endeavour to fulfil your order once completed and paid for. If a product should become unavailable after your order has been confirmed and paid for, we will refund the price you paid for the product within 30 days following the date of payment. If relevant, we will offer you a replacement for an unavailable product, a product of equal price and quality. If you choose to decline this offer, and the original product is permanently unavailable, we will reimburse the price of the unavailable product.

SECURE PAYMENT
You must pay for the Order in full at the time of ordering by one of the payment methods we accept on the site. You must be fully entitled to use the payment method used for purchases. These payment options use advanced SSL encryption to keep your transaction secure and do not cost you anything to use.

DELIVERY
Your order will be delivered to the address you indicated when your order was placed. We do not deliver to Post Office Box (PO Box) addresses.
WaterForce Limited does everything in its power to respect the delivery times indicated on the Web Store. We cannot, however, be held responsible for the consequences of a late delivery or the loss of a package caused by a third-party contracted to make delivery, or by you, or because of some unforeseen event or an Act of God. In the event where you do not receive your package, an investigation will be conducted with the carrier and may take several days upon receipt of your claim. During this period of investigation, no reimbursement or re-delivery will take place.

Orders may be dispatched from multiple stores, so may arrive in multiple shipments.

RIGHT OF RETURN
WaterForce Limited allows you 14 days to return a product that you are not satisfied with. Your right of return starts from the moment your order is delivered. You can return the product to us within this time frame, at your own expense, with your completed returns form.

PRIVACY AND PROTECTION OF PERSONAL DATA
The details you give us are essential for the processing, invoicing and delivery of your orders, therefore failure to provide these details will result in the failure of your order. By registering on the Site, you agree to provide us with sincere and true information as it concerns you. Communicating false information is contrary to the present general Terms and Conditions.
You have the permanent right to access and rectify all the information that concerns you. You can at any time make a request to WaterForce Limited to find out what personal information we hold concerning you. You may at any time, and by request, modify this information.  WaterForce will not share your personal information with any third party.

We do not hold credit and/or eftpos card details on the Web Store.

GIFT CARDS
Gift Vouchers expire 12 months from date of purchase.

INTELLECTUAL OWNERSHIP
All the content on the Waterforce web store is the property of Waterforce Limited who holds all intellectual ownership and copyright in respect of the same. Any reproduction, either partial or total, of such content by any means is prohibited unless with the expressed written authorisation of Waterforce Limited. Any breach of this clause shall be the subject of appropriate legal action undertaken by Waterforce Limited which could involve a claim for significant cost in damages

WAIVER AND SEVERABILITY
Any failure of WaterForce to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The Terms of Service constitutes the entire agreement between you and WaterForce, and governs your use of the service, superseding any prior agreements (including, but not limited to, any prior versions of the Terms of Service). If any provision of these Terms of Service is held by a court of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Service will continue in full force and effect.

FEEDBACK & COMMENTS
Any opinions left on the Web Store are screened and moderated by WaterForce Limited. If the comments infringe on the law or are inappropriate, WaterForce Limited reserves the right to remove or modify them.

SHIPPING AND RETURNS
We ship every business day, NZ wide. Most NZ orders will be shipped within 1-2 days, we will email you if there is going to be a delay.

RETURN OF PRODUCTS / REFUNDS
You may return new and unused items sold by WaterForce Limited within 14 days of delivery for a full refund.  Items should be returned in their original product packaging, in new condition. We will pay the return shipping costs if the return is a result of our error, otherwise it is up to you to ship it to us.
If you make an ordering error or change your mind and wish to return items, you will be required to pay the shipping expense. Also if you return the large portion or an entire order, and we paid the shipping, we may deduct costs from your refund.
Product NOT acceptable for return:

    Goods that have been invoiced from more than 14 days.
    Goods that are dirty, damaged or not in original packaging which are unsuitable for resale.

WARRANTY
Goods attract a warranty period specified by the manufacturer and will vary from product to product.  At a minimum we meet our requirements under the Consumer Guarantees Act.  Warranty covers only defect as a result of manufacturing defect or faulty parts. We are not obliged to replace products if they can be repaired. In accordance with consumer laws, replacement product will only carry warranty for the duration of the warranty period of the original product purchased. Warranty does not cover any labour costs. Abuse or neglect of a product, or product being used outside of its intended use or application will void any warranty. We reserve the right to obtain any information in order to determine cause of failure. Failure of a product within the warranty period does not automatically constitute or guarantee warranty.


Waterforce Limited will not be liable for any situation which may arise as a result of force majeure or act of god. Notwithstanding anything indicated in these terms and conditions or provided for under any applicable Law, Waterforce Limited will not be liable either in contract or in tort for any consequential, incidental, indirect, special or punitive damages, including business interruption, loss of future revenue, profits or income, diminution in value or loss of business reputation or opportunity relating to breach or alleged breach hereof or otherwise.

Please Note: We may ask for photos of the product for identification and inspection.
If you are wanting to return products, we recommend taking photos as soon as possible especially if the reason for returning the product is due to damage. For the photos, please take clear images of the product as a whole, as well as details on product (e.g. If damaged a photo of damaged area. If incorrect size an image of the size if written on the product).
